Service Terms and Conditions for Waste Collection Holland Park
These Terms and Conditions set out the basis on which Waste Collection Holland Park provides waste collection and related services to domestic and commercial customers. By making a booking, confirming a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before arranging any waste collection.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, organisation or other entity requesting or receiving waste collection or related services.
Company means Waste Collection Holland Park, the provider of the services.
Services means any waste collection, removal, loading, transportation, recycling, disposal or associated services provided by the Company.
Waste means household, commercial or other non-hazardous waste material that the Company has agreed to collect.
Booking means any confirmed request by the Customer for the Company to provide Services, whether made by telephone, email, online form or in person.
2. Scope of Services
The Company provides waste collection and related services within its operating area, which includes Holland Park and surrounding locations as notified by the Company from time to time. Services may include single collections, regular scheduled collections, bulky waste removal, office or home clearances and other non-hazardous waste solutions.
The Company reserves the right to refuse to collect any item or type of waste that, in the Company’s reasonable opinion, is unsafe, prohibited by law, classified as hazardous, or outside the agreed scope of the Booking.
3. Booking Process
3.1 The Customer may request a quotation and arrange a Booking by contacting the Company via telephone, email or any authorised booking system operated by the Company.
3.2 When making a Booking, the Customer must provide accurate and complete information, including:
a) The full collection address and any access restrictions.
b) The type and estimated volume or weight of waste to be collected.
c) Any items that may require special handling.
d) Preferred dates and times for collection.
3.3 Quotations are based on the information provided by the Customer. If on arrival the volume, weight or nature of the waste materially differs from the description supplied, the Company may revise the price, adjust the scope of the Services or decline to carry out the work.
3.4 A Booking is confirmed only when the Company has accepted the request and, where applicable, the Customer has accepted the quoted price or paid any required deposit.
4. Access and Customer Responsibilities
4.1 The Customer must ensure that the Company’s vehicles and operatives have safe and reasonable access to the collection location at the agreed time.
4.2 The Customer is responsible for obtaining any necessary permissions, permits or approvals required to allow the Company’s vehicles to enter private land, controlled parking zones or restricted areas.
4.3 The Customer must ensure that waste is presented in a safe manner, without sharp objects exposed, and that any bags or containers used are suitable for carrying the waste.
4.4 The Customer must not place hazardous, prohibited or dangerous materials out for collection unless this has been expressly agreed in writing and in compliance with applicable regulations.
4.5 If the Company is unable to access the waste or complete the collection due to circumstances within the Customer’s control, the Company reserves the right to charge a call-out or wasted journey fee.
5. Pricing and Quotations
5.1 Prices for Services are normally based on the type of waste, volume and/or weight, the labour required, and the location of the collection.
5.2 Any quotation issued by the Company is an estimate only, based on the information supplied by the Customer. The final price may change if the actual waste differs from the original description or if additional labour or time is required.
5.3 Prices are quoted in pounds sterling and may be subject to value added tax or other applicable taxes, which will be added at the prevailing rate where relevant.
5.4 The Company reserves the right to amend its prices, fees and charges at any time. Any change in pricing will not affect Bookings that have already been confirmed, except where the scope of work changes.
6. Payments and Invoicing
6.1 Payment terms will be confirmed at the time of Booking. Unless otherwise agreed in writing, payment is due immediately upon completion of the collection, or in advance if required by the Company.
6.2 The Company accepts payment by the methods it notifies to the Customer, which may include cash, debit card, credit card, bank transfer or approved account invoicing for commercial customers.
6.3 Commercial Customers may apply for credit terms, which are subject to approval, credit checks and the Company’s discretion. Where credit terms are agreed, invoices are payable within the period specified on the invoice.
6.4 If the Customer fails to make payment by the due date, the Company may charge interest on the overdue amount at the statutory rate and may suspend further Services until all outstanding sums have been paid.
6.5 The Customer remains liable for all charges properly incurred for Services provided, including any additional costs resulting from incomplete or inaccurate information supplied at the time of Booking.
7. Cancellations and Amendments
7.1 The Customer may request to cancel or amend a Booking by contacting the Company as soon as possible during normal business hours.
7.2 If the Customer cancels a Booking with sufficient notice, as specified by the Company from time to time, no cancellation fee will usually apply. The required notice period will depend on the nature and scale of the Booking.
7.3 If the Customer cancels with insufficient notice, or fails to be present or provide access at the scheduled time, the Company may charge a cancellation or wasted journey fee to cover costs incurred.
7.4 The Company reserves the right to cancel or reschedule a Booking in the event of vehicle breakdown, staff illness, severe weather, access issues, safety concerns or other circumstances beyond its reasonable control. In such cases, the Company will inform the Customer as soon as reasonably practicable and arrange an alternative time where possible.
8. Waste Regulations and Prohibited Items
8.1 The Company operates in accordance with applicable UK waste management laws and regulations, including duties relating to the handling, transport and disposal of controlled waste.
8.2 The Customer is responsible for ensuring that all waste presented for collection is lawful for the Company to handle and is not hazardous or prohibited, unless the Company has expressly agreed to handle such waste in compliance with relevant regulations.
8.3 Without prior written agreement, the Company does not collect or transport items such as:
a) Asbestos or materials containing asbestos.
b) Clinical or medical waste, syringes or pharmaceuticals.
c) Flammable, explosive, corrosive or otherwise dangerous substances.
d) Gas bottles, oil drums, fuel, solvents or chemicals.
e) Pressurised containers or other specialist hazardous items.
8.4 If prohibited or hazardous items are discovered amongst the waste, the Company may refuse to collect them, leave them on site, or return them to the Customer. The Customer will be liable for any resulting costs, including additional handling, safe disposal, cleaning or regulatory charges.
9. Service Performance and Recycling
9.1 The Company will use reasonable care and skill in providing the Services and will endeavour to carry out collections at the agreed time. However, collection times are approximate and may be affected by traffic, access difficulties and other operational factors.
9.2 The Company aims to minimise disposal to landfill and will, where reasonably practicable, sort, segregate and direct waste for recycling, reuse or recovery in accordance with good industry practice and regulatory requirements.
9.3 Once the waste has been removed from the Customer’s premises, it becomes the property of the Company, and the Company will determine the appropriate method of treatment or disposal in compliance with applicable law.
10. Damage, Liability and Indemnity
10.1 The Company will take reasonable care to avoid damage to property while providing the Services. The Customer is responsible for identifying and pointing out any known risks, fragile surfaces or access concerns at the time of Booking or before work commences.
10.2 The Company’s liability for any loss or damage to property arising from its negligence shall, where permitted by law, be limited to the direct cost of repair or replacement of the affected item, taking into account fair wear and tear and any pre-existing condition.
10.3 The Company shall not be liable for:
a) Any indirect, consequential or economic loss, including loss of profit, loss of business or loss of opportunity.
b) Any loss or damage arising from inaccurate information provided by the Customer.
c) Any loss resulting from delays or failure to perform the Services due to events beyond the Company’s reasonable control.
10.4 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
10.5 The Customer shall indemnify and keep indemnified the Company from and against all claims, liabilities, losses, damages, costs and expenses arising from:
a) The presence of hazardous or prohibited items in the waste not disclosed to the Company.
b) Any breach by the Customer of these Terms and Conditions or applicable waste regulations.
11. Customer Property and Personal Items
11.1 The Customer must ensure that no personal belongings, valuables or important documents are left within items or areas designated for waste removal.
11.2 The Company is not responsible for any personal items that are removed as waste and shall have no obligation to search through waste for items believed to have been discarded accidentally.
12. Complaints and Disputes
12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as reasonably practicable, explaining the nature of the issue and providing relevant details.
12.2 The Company will investigate complaints promptly and aim to resolve them in a fair and reasonable manner. The Customer agrees to give the Company a reasonable opportunity to remedy any valid issues before pursuing further action.
13. Data Protection and Privacy
13.1 The Company collects and processes personal information about Customers for the purposes of managing Bookings, providing Services, administering accounts and complying with legal obligations.
13.2 The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom.
13.3 The Customer is responsible for ensuring that any contact details provided are accurate and kept up to date so that the Company can communicate effectively regarding Bookings and Services.
14. Variations to these Terms
14.1 The Company may update or amend these Terms and Conditions from time to time. Any revised terms will be published or otherwise made available and will apply to new Bookings made after the date of publication.
14.2 For ongoing or long-term service arrangements, the Company will notify the Customer of any material changes to these Terms and Conditions and will provide reasonable notice where practicable.
15. Severability
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, such provision shall be severed from the remaining terms, which shall continue to be valid and enforceable.
16. Entire Agreement
16.1 These Terms and Conditions, together with any written quotation, confirmation or specific service agreement issued by the Company, constitute the entire agreement between the Company and the Customer in relation to the provision of the Services.
16.2 The Customer acknowledges that they have not relied on any statement, promise or representation made or given by or on behalf of the Company that is not set out in these Terms and Conditions or in a written agreement.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter or formation.
By placing a Booking with Waste Collection Holland Park, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
